Why is it important to use a licensed builder?

Under the Home Building Act 1989 (NSW), all residential building work valued over $5,000 (including labour and materials) must be carried out by, or under the supervision of, a holder of a current contractor licence. Using an unlicensed builder exposes you to significant legal and financial risk, including potential difficulty obtaining insurance, selling your property, or pursuing claims if something goes wrong.

Does TuCasa Constructions hold the required insurance?

Yes. As a licensed builder in NSW, we hold the mandatory insurances required by law, including:  Home Building Compensation (HBC) Cover — formerly known as Home Warranty Insurance. This is a statutory insurance that protects homeowners against incomplete or defective work in the event a builder becomes insolvent, dies, or disappears. It is required for all contracts over $20,000.  Public Liability Insurance — covering injury or property damage to third parties arising from our work.  Workers Compensation Insurance — covering all employees and relevant subcontractors on site.  We are happy to provide copies of our certificates upon request.

Will I receive a written contract?

Yes — always. In NSW, a written contract is a legal requirement for all residential building work valued over $5,000. For work valued at $20,000 or more, a formal written contract under the Home Building Act 1989 is mandatory.  Your contract with TuCasa Constructions will clearly set out the scope of work, agreed price, payment schedule, project timeline, materials specifications, and the rights and obligations of both parties. We encourage all clients to read the contract carefully; we are more than happy to discuss items in the contract and provide further clarification if needed.

What does a typical payment schedule look like?

For contracts over $20,000, NSW law governs how progress payments are structured. Payments are made in stages that correspond to defined milestones in the construction process — such as commencement, frame completion, lock-up, and practical completion.  By law, a builder cannot request a deposit greater than 10% of the total contract price for contracts over $20,000 (or 5% for contracts over $1 million). We will clearly outline the payment schedule in your contract prior to commencement.

Can the contract price change once work has started?

Variations to the agreed scope of work may result in adjustments to the contract price. Under NSW law, all variations must be documented in writing and agreed to by both parties before the additional work is carried out. We will always discuss any potential changes with you and obtain your written approval before proceeding.

What happens if I need to cancel or withdraw from the contract?
